Terms & Conditions – INDRA (Individualised Non-Standard Dialogue Recognition Application)

Welcome to INDRA –  the Individualised Non-Standard Dialogue Recognition Application (the “App”), operated by PolariseMe FZE. Please read these Terms carefully. By using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Purpose & Nature of the Service

INDRA (Individualised Non-Standard Dialogue Recognition Application) is an AI-powered accessibility and assistive communication application designed to support individuals with speech impairments by mapping spoken audio to trained phrases using personalized machine learning models.
The App is provided solely as a communication aid and assistive technology. It does not replace human judgment, caregivers, clinicians, interpreters, or professional services.

2. Acceptance of Terms

By using the App, you confirm that:

  • You are legally capable of entering into a binding agreement;

  • You accept these Terms and the Privacy Policy;

  • You understand the limitations of artificial intelligence systems;

  • You consent to the collection, processing, and storage of your data as described herein.

Note: PolariseMe may update these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.

3. Eligibility, Children & Vulnerable Users

  • The App may be used by individuals of all ages.

  • Users under 13 or otherwise legally unable to consent must have consent provided by a parent, legal guardian, or authorized caregiver.

  • For users with speech or cognitive impairments, you and/or your caregiver:

    • Understand the probabilistic and imperfect nature of AI classification;

    • Accept the risks of misclassification;

    • Supervise use where appropriate;

    • Assume responsibility for decisions made using the App.

4. Description of Services

The App allows users to:

  • Record speech samples;

  • Train personalized speech intent classification models;

  • Store training data and model outputs;

  • Use AI-generated predictions to assist communication.

All outputs are generated algorithmically and may be inaccurate, incomplete, delayed, or incorrect.

5. Artificial Intelligence Disclosure

You acknowledge that:

  • The App uses AI and machine learning technologies;

  • AI outputs are probabilistic, not deterministic;

  • Predictions may be incorrect or misleading;

  • Accuracy varies based on training data, environment, and usage;

  • AI outputs must be reviewed and interpreted using human judgment.

6. Best Efforts & No Guarantee of Accuracy

  • The App operates on a best-efforts basis using personalized machine learning classifiers.

  • PolariseMe does not guarantee correct mapping of audio to intended phrases.

  • No accuracy thresholds, performance levels, or service levels are guaranteed.

  • Results may vary materially between users and sessions.

  • Use of the App is entirely at your own risk.

7. No Medical, Emergency, or Safety-Critical Use

The App is not intended for:

  • Medical diagnosis, treatment, or therapy;

  • Emergency communications or services;

  • Legal, financial, or safety-critical decisions;

  • Situations involving risk of serious harm or death.

In emergencies, contact appropriate emergency services immediately.

8. No Reliance

You agree not to rely on the App as:

  • A sole or primary method of communication;

  • A substitute for caregivers, clinicians, interpreters, or support persons;

  • A system for conveying legally significant, emergency, or life-critical information.

PolariseMe is not responsible for any harm arising from reliance on App outputs.

9. User Responsibilities

You agree that you will:

  • Use the App only for lawful purposes;

  • Not misuse, misrepresent, or over-rely on AI outputs;

  • Not attempt to reverse engineer, copy, or interfere with the App;

  • Not compromise security or system integrity;

  • Be solely responsible for decisions made using the App.

10. Accounts & Security

Some features may require account registration and third-party authentication. You are responsible for safeguarding your credentials and all activity under your account.

11. Audio Data, Training Data & Model Rights

By using the App, you grant PolariseMe a worldwide, royalty-free, sublicensable license to:

  • Record, store, process, analyze, and transform your audio recordings;

  • Use recordings to train, validate, and operate personalized AI models;

  • Use de-identified and aggregated data to improve algorithms, models, and services.

Note: All trained models, derivatives, and improvements are the sole property of PolariseMe.

12. Data Protection, Privacy & GDPR

PolariseMe processes personal data according to applicable laws, including GDPR, UK GDPR, UAE PDPL, and other privacy regulations.

You consent to:

  • Collection and processing of identifiable audio recordings;

  • Storage of training audio, spoken audio submitted for classification, and metadata;

  • Creation and use of personalized AI models;

  • Retention of audio and logs for operational, security, quality, compliance, and dispute resolution purposes;

  • Use of de-identified and aggregated data for research and algorithm improvements;

  • Cross-border transfers with appropriate safeguards.

13. Data Retention

Audio data, logs, and model artifacts may be retained for operational, security, compliance, and improvement purposes, subject to law and de-identification practices.

14. Intellectual Property

All intellectual property rights in the App, including software, algorithms, models, designs, trademarks, and content, are owned by PolariseMe or its licensors.

15. Third-Party Services

The App relies on third-party infrastructure. PolariseMe is not responsible for interruptions, changes, or failures caused by third parties.

16. Disclaimer of Warranties

The App is provided “as is” and “as available”. PolariseMe disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. POLARISEME MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

  • POLARISEME SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR EXPENSES OF ANY KIND, WHETHER DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE, INCLUDING BUT NOT LIMITED TO:

    • MISCOMMUNICATION, MISINTERPRETATION, OR ERRONEOUS AI OUTPUTS;

    • PERSONAL INJURY, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE;

    • LOSS OF DATA, REVENUE, BUSINESS, OPPORTUNITY, OR PROFITS.

  • USERS ACKNOWLEDGE AND AGREE THAT THEY ASSUME ALL RISKS ASSOCIATED WITH USING THE APP, INCLUDING BUT NOT LIMITED TO ERRONEOUS OUTPUTS OR MISCLASSIFICATIONS.

  • TO THE EXTENT ANY LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF POLARISEME SHALL BE LIMITED TO ZERO (0) AED.

18. Assumption of Risk

You assume all risks associated with the App, including incorrect phrase mapping or miscommunication.

19. Indemnification

You agree to indemnify and hold harmless PolariseMe and its affiliates from claims, losses, liabilities, or expenses arising from your use or misuse of the App.

20. Termination

PolariseMe may suspend or terminate access at any time, with or without notice, for violations of these Terms.

21. Changes to Services

PolariseMe may modify, suspend, or discontinue any part of the App at any time without liability.

22. Export Controls & Compliance

You agree to comply with all applicable export control, sanctions, and data protection laws.

23. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates. Disputes are subject to the exclusive jurisdiction of the courts of Ras Al Khaimah, UAE.
